距离国会反对党领袖安华提出的916变天仅剩不到3天,民联夺得中央政权的计划能否成功,乃是国人瞩目的焦点。尽管安华言之凿凿地表示变天势在必行,不过同属盟友的行动党雪州议长邓章钦却认为,9月16日当天不会换政府


尽管对916变天保持很高期待,但这名执业律师却引据《联邦宪法》,声称变天计划还存有许多技术问题有待处理,因此中央政权不会在9月16日当天易手。

他表示,从宪法角度来看,一个政权交替和转移有两种方法,
其一是取得大多数议员的签名并征得国家元首的同意,
其二则是在国会向现任首相投不信任票,以选出新首相。

变天需征询国家元首同意
不过,他说,9月16日当天会发生这两种情况的可能性微乎其微
"首要前提是,民联必须获得至少30名国会议员加盟。
在取得大多数议员的签名支持后,民联还须征询国家元首的同意,才能改换政权。"

“根据联邦宪法第40章,元首具有绝对权力决定解散国会和委任新首相。假设安华真的取得多数议员的签名支持,元首也可以说这批议员受威迫下签名,而拒绝让安华成为新首相。”

国会休会无法投不信任票
邓章钦续说,若此法不通,安华就必须动员大多数议员在国会内向首相投不信任动议,然而此事耗时良久,而且国会正在休会,不可能赶在9月16日前完成。

邓章钦是在昨晚《独立新闻在线》3周年筹款晚宴的专题座谈会"安华与纳吉的政治角力"上,这么表示。除了邓章钦外,其他主讲人包括了时评员唐南发、雪民政党中委卢永平与前马华妇女组署理主席陈仪乔。
主持人则是《独立新闻在线》总编辑庄迪澎。
共有600人左右出席了有关晚宴。

阿都拉不会拱手让出政权
邓章钦指出,民联若要进行变天大计,还得面对一个隐忧,即阿都拉政府不可能会轻易地拱手让出政权。
“以阿都拉最近的大动作看来,他不可能拱手交出政权。就算安华真获得足够议员支持,阿都拉也可能会见国家元首,要求解散国会,重新大选。”
“916变天大计要成功,除非一切进展顺利。安华获得超过30名国会议员弃暗投明,而阿都拉又如往常般软弱无能愿意交出政权,变天才能成事。”

内安法令图酝酿白色恐怖
另一名主讲人陈仪乔也认为阿都拉不可能会拱手交出政权。她表示,随着916日期逼近,可感觉国内的气氛已越来越紧张,政府更欲借内安法令来制造一股白色恐怖气氛。

她说,国阵政府这种高压行动反映了当权者对变天大计的恐惧,也让人民越来越期待政权变天的发生。

乡村安娣已出现政治醒觉
她同样认为916变天不大可能会发生,不过她说,若变天计划真能成功,不是安华的胜利,而是民心所向的体现。她指出,经过了308全国大选后,人民的政治普遍觉醒,对国阵政府已近绝望,即连乡镇的“安娣”也密切关注国内的时事进展。

这名前马华妇女组强人笑着举例说,“以前我还未退出马华时,到乡村的发型屋美发,只见店内的安娣看到我都只静静不出声。后来我退出马华,我到同一家发型屋,却受到她们蜂拥上前,七嘴八舌地与我谈政治。”
她也表示,916变天计划的成功之处,在于安华让全民重新认识了9月16日这个大马成立日,也把其本身塑造成一个全民领袖的形象,更显示国阵成员党过往的沟通方式和策略已宣告失败。

著名部落客阿希鲁丁阿旦表示,巫统内部反对阿都拉领导的派系正在积极进行整合,企图打造一支强大的“梦幻队伍”,准备在来届党选给党主席阿都拉迎头痛击。这支梦幻队伍,以东姑拉沙里为首,将出战巫统主席位置,而挑战署理主席的人选则可能是巫统副主席慕尤丁或资深领袖莱士雅丁。

他指出,副首相兼巫统署理主席纳吉对这样的变化感到担忧,更为此事主动会见了马哈迪。

SEPT 14 - Forget about September 16.
September 18 is shaping up to be a far more important day for Malaysia with far reaching consequences for Prime Minister Abdullah Ahmad Badawi"s two-year transition plan and Tan Sri Muhyiddin Yassin"s political future.

Next Thursday, the Umno Supreme Council will convene and the top of the agenda is likely to be Abdullah"s plan to hand over the reins of power in the party to Datuk Seri Najib Abdul Razak.

The council unanimously endorsed the transition plan in July. But following the Barisan Nasional"s defeat in Permatang Pauh on August 26 and his meeting with Tun Dr Mahathir Mohamad in early September, Muhyiddin has called for a review of the plan.

Speaking on the sidelines of the Forbes Conference in Singapore last week, he urged Abdullah to step down earlier, saying that the two year timetable was no longer tenable.

He has followed up that call with cutting comments about Abdullah"s ability to lead Umno and Barisan Nasional. The Minister of International Trade and Industry may have moved too fast.

Comments from several supreme council members and ministers show that not everyone believes that the transition plan should be revisited.

Others like Wanita Umno chief Datuk Seri Rafidah Aziz, Negeri Sembilan Mentri Besar Datuk Mohamed Hsssan, Works Minister Datuk Zin Mohamed and defacto Law Minister Datuk Zaid Ibrahim feel that Muhyiddin should be punished for going public with his comments about the transition plan and his criticism of Abdullah.

A key player at the Sept 18 meeting will be Najib. He is under pressure from his supporters on the ground to push for a quicker handover of power.
Their argument is this: Najib could become collateral damage in the current anti-Abdullah mood.

Former prime minister Tun Dr Mahathir Mohamad has also exerted pressure on the DPM, giving him and ultimatum of sorts during a recent meeting: challenge Abdullah or risk having your dirty linen washed in public.

Najib"s comments on Friday where he said that it was up to party members to decide on the transition plan has sparked speculation that he is ready to back Muhyiddin"s idea of reviewing the transition plan.
His opening statement at the September 18 is likely to set the tone of the debate at the council meeting.
If he confirms that he is still committed to taking over the party presidency and the leadership of the country in 2010, this will mark the beginning of the end of Muhyiddin.

It could force the Umno vice-president to resign from the Cabinet and officially declare himself the running mate of Tengku Razaleigh Hamzah.

If Najib supports the call for a review of the transition plan, Abdullah"s political enemies and critics will pound and harass him further.

On the ground, the Umno divisions will take the DPM"s change in stance as a signal that he is willing to accept nominations as the party president.

At the moment, the DPM is still committed to the 2010 hand over, telling his friends that he is still more comfortable with Abdullah than he is with Muhyiddin or Dr Mahathir.
But there are still a few more days to go before the defining meeting for Umno, Abdullah, Najib and Muhyiddin.

KUALA LUMPUR, Malaysia (AP) — Malaysia's ruling establishment faced fresh criticism Sunday after claiming that a journalist was detained under a draconian law for her own safety, with even a pro-government newspaper calling the explanation "most ridiculous."
Tan Hoon Cheng, a reporter of the Chinese-language newspaper Sin Chew, was arrested Friday under the Internal Security Act, which allows indefinite detention without trial. She was, however, freed Saturday.
An opposition lawmaker and the editor of a pro-opposition news Web site were also detained under the ISA on Friday, but have not been released.
The action has drawn widespread criticism from opposition politicians, the Bar Council, human rights groups and now even by some in the government-controlled media.
Tan's arrest "will go down in Malaysian history as the most controversial, if not most ridiculous," Wong Chun Wai, the editor of the influential Sunday Star, wrote in a signed opinion piece.
The Star is owned by the Malaysian Chinese Association (MCA), the second largest party in the ruling coalition after Prime Minister Abdullah Ahmad Badawi's United Malays National Organization party.
Wong's article is in some measure a reflection of the Chinese association's growing unhappiness with UMNO, which controls most power in the country. A wedge was driven between the two last month after Ahmad Ismail, an UMNO politician, described the ethnic Chinese minority as "squatters" and accused them of hungering for power.
Tan was the first journalist to report the comments.
The schism in the ruling coalition comes as it faces the threat of being ousted by opposition leader Anwar Ibrahim, who has capitalized on a deep feeling of discrimination among the minority Chinese and Indians.
On Saturday, Home Minister Syed Hamid Albar defended the three detentions by saying they were necessary to prevent racial conflict. He said Tan, an ethnic Chinese, was arrested because police received information that her life had been threatened.
If that was the case, police should have given her protection instead of arresting her, said Malaysian Chinese Association youth wing chief Liow Tiong Lai.
"It is not a clever excuse," he said in a statement.
"To put it bluntly, the arrest was outrageous and went against the grain of natural justice," Wong wrote.
"In the eyes of the world, we are becoming more like a political basket case each day as old politicians attempt to bring back their outdated tricks," he wrote.
Many Malaysians have also been outraged that Ahmad, the Malay politician, faced no legal action for his allegedly seditious statements. He was suspended from the party for three years.
"There is a sense of injustice and hurt among people that the perpetrator has been let off scot-free while the messenger has been penalized," Wong wrote.
He said Ahmad's racist comments were sufficient to get him charged with sedition or arrested under the Internal Security Act.
"But the ISA is a draconian and archaic law. It shouldn't be used even against Ahmad, as this deprives him of the right to defend himself in open courts," he wrote.
In a separate editorial, the newspaper joined opposition parties, lawyers and human rights groups in demanding an end to the Internal Security Act.
The law "is a shameful blot on the country's dignity," it said.
