Lack Of Monitoring Showed ! Everytime ..and fucking everytime the fucking same ..

Hillslopes Development and Bukit Antarabangsa Tragedy
Posted by Datuk Seri Dr. Chua Soi Lek (Thursday, December 11, 2008) at 4:05pm

In the last 15 years, there were 13 major landslides in Hulu Kelang area, of which 5 were in Bukit Antarabangsa area.
malaysiakini to post this ==>
There are clear guidelines of highlands development by the Ministry of Environment. These guidelines are not only set out clearly according to the gradient of hillslopes, it also laid out steps to be taken to ensure safety on hillslopes development. They should be strictly adhered to, regulated, monitored and enforced.

Highland developments are classified into:

a) Class I - Gradient Less than 15 degrees

b) Class II - Gradient more than 15 to less than 25 degrees

c) Class I & Class II - For Development with Conditions

d) Class III - Gradient more than 25 to less than 35 degrees-little development allowed

e) Class IV - Gradient more than 35 degrees-No development allowed

There are even details about the qualifications and experience of consultants involved in the projects. However, it looks good on paper only.

When such tragedy occurs, many questions remain unanswered, especially who is to be held liable:

1. The approving authority is the local authority and often it lacks the technical know how and have to be dependent on other bodies. We are given to understand that the Ampang council does not even have a senior engineer to supervise Highland development.

2. There should be close supervising during the project implementation. If there are EIA requirements, who is to ensure that mitigating measures are followed and enforced? Supervision we are told is lacking.

3. Who is the Monitoring Authority? Often coordinated approaches involving many technical departments are required. It cannot be left to the local authority, which is lack of the expertise. If these consultants both private and government are involved, then they should be held accountable. It is they who are the experts, who certified the projects safe.

4. When the projects are completed, who is responsible for monitoring the projects and for how long it should be monitored? Leaving it to the developer to do the job of maintenance without being monitored is NOT the best method to ensure compliance.

5. Often if developments are by different contractors and developers – there is no coordination among them of who undertakes the coordination. There are accusations that some landowners / developers cut down their lands if the gradient is too steep to less steep (<35)degrees.>Every landslide and tragedy provides an opportunity to the authority to investigate the actual cause of the landslides – what went wrong and who is responsible. Often nobody seems to be accountable. The usual finger pointing and blame game starts.
a) Was it a design fault?

b) Did the construction go according to plan?

c) It is a maintenance problem that causes the landslides?

The victims and rakyat have the right to know who is responsible or accountable when tragedy strikes.

It cannot be an “Act of God” always. We are given to understand that while some consultants have paid the price of being negligent, no private developers have ever been brought to court for failing to comply with conditions laid down by the local authority.

The State Government and Federal Government must show that they are committed to ensure safety on hillslopes development. We may have to learn from Hong Kong how they overcome their problems on hillslopes development, otherwise landslides will continue and more tragedies will occur.

Buyers should NOT be faulted for buying houses on the hillslopes. We take it that the buildings are safe after the authority have approved it and certified it fit for occupation. However buyers have to be more careful in purchasing hillslopes houses. It can be time bomb.

Meanwhile the authority may want to review all hillslopes development that have been approved but not implemented. As for ongoing projects, it should be strictly monitored and regulated.

malaysiakini to post this ==>

Bukit Antarabangsa Tragedy - Hillslope Development
Posted by Datuk Seri Dr. Chua Soi Lek (Monday, December 8, 2008) at 3:58pm

The latest Bukit Antarabangsa Tragedy in Kuala Lumpur once again demonstrates the Malaysian boleh for the wrong reason.

Landslide in the vicinity of Bukit Antarabangsa is not alien to us. It is a tragedy that occurs with such frequency that we have to ask ourselves whether we are wiser after each disaster. We may be sad, but are we any wiser?

The usual blame game will start and new directives have been issued by the PM to state government and local council. This will be repeated when the next tragedy strikes again.
malaysiakini to post this ==>
Hillslope development and landslide tragedy is a classic example of greed, inefficiency in implementation and poor monitoring or to be exact no monitoring.

There are clear guidelines for hillslope developments. There is also a cabinet committee on hillslope development with very clear guidelines according to the gradients of the hillslopes and measures to be undertaken. Often this remains good only on paper.

There are some issues that need to be taken in consideration for hillslope development.

1. Are projects approved according to guidelines in high-risk hillslope Development?

2. Are there any measures to stabilize the hillslope implemented?

3. Who is the monitoring authority? A coordinated approach involving JKR, DOE, JPS, local council and geotechnical experts are required.

4 When the project is completed, who is responsible for monitoring the hillslope stability?

5. What about the professional consultants (from engineers to architects) – are they also not liable, can they be sued so that there are more professionalism and commitment in their work?

I have written many times in this blog that EIA Report and other mitigating measures remain good on papers only since there is hardly any effective monitoring and enforcement.

Political will is required. Meanwhile, there should not be any cutting of trees and vegetations on hillslopes that are earmarked for development. Buyers should be more demanding and discerning about purchasing houses on hillslopes. Panoramic view and fresh air is good if there is soil and slope stability.

http://drchua9.blogspot.com/2008/12/bukit-antarabangsa-tragedy-hillslope.html

malaysiakini to post this ==>

landslide eli wong town hall meeting the resident

National Slope Master Plan ready next year
KUALA LUMPUR, Dec 7 — malaysiakini to post on this ==>
Those occupying buildings in slope development areas will be asked to vacate their premises if they are found to be on the list of risky slopes under the National Slope Master Plan expected to be ready early next year.

Under the master plan, ongoing development projects will be asked to stop if they are found to be in high-risk slope areas.

Deputy Minister of Housing and Local Government, Datuk Robert Lau Hoi Chew, said development on Class 3 and Class 4 slopes is categorised as high-risk.

The master plan, to be drawn by the Public Works Department (PWD), will provide guidelines on construction and development on slopes and his ministry will use it to monitor projects, Lau said at the scene of the Bukit Antarabangsa landslide today.

On the call by Prime Minister Datuk Seri Abdullah Badawi that housing projects on hill sides and on high-risk slopes be halted, he said it should be supported.

“If construction is going on, investigation should be done carefully,” he said.

On the allegation of a Bukit Antarabangsa resident who said that the Ampang Jaya Municipal Council (MPAJ) did not investigate the causes of fallen trees a few months ago, Lau said there may be “negligence” on the part of MPAJ in the matter.

“If MPAJ received the information and did not investigate and take appropriate action, that is not right,” he said. — Bernama

Set up slope management to prevent landslides, says expert
malaysiakini to post on this =>
KUALA LUMPUR, Dec 7
— Bukit Antarabangsa’s slope management and inventory should be established to monitor the risk of each slope in the area.

This is to ensure a stringent and continuous slope monitoring by the authorities, a geology expert suggested today.

Prof Datuk Dr Ibrahim Komoo said this could help the authorities identify areas prone to landslides and give early warning to the public which could help save lives since the area was identified as high-risk.

The director of Universiti Kebangsaan Malaysia’s Institute for Environment and Development (Lestari), who has been involved in various studies carried out by the authorities after each major landslide in the area, said:

“What is needed now is that there should be slope management and slope inventory on the area as there are already enough data from previous studies on the soil conditions and geological setting of the area.

“The studies are enough. The engineers have understood (the soil and geological situation of the area). Now, it’s the action,” he said today.

He was asked to comment on yesterday’s early morning landslide which killed four people and buried 14 bungalows in Taman Bukit Mewah and Taman Bukit Utama, Bukit Antarabangsa.

Ibrahim said the Ampang Jaya Municipal Council (MPAJ) needed to begin “profiling and monitoring management of each slope in the area”.

“Currently, the authorities do not have the (relevant) information like where the slopes are; where the catastrophic areas are or which slopes are at risk.

“Nobody can give the answers,” he lamented.

Ibrahim, one of the leading experts who conducted the study of the Bukit Antarabangsa area, following the Highland Towers tragedy which killed 48 people on Dec 11, 1993, has identified this area as a high-risk area.

“Its soil condition is prone to landslides, and related geological setting and soil conditions also proved that,” he added.

Expressing disappointment with the slope management in Bukit Antarabangsa, Ibrahim said: “In Malaysia, once a company has developed a housing project and handed it over to the owner, everybody washes their hands.”

“I have actually been frustrated long enough when it comes to Bukit Antarabangsa. Every time it rains, I have anticipated (that) something like this would happen,” he said.

Ibrahim was also involved in carrying out studies on a Oct 5, 2002 landslide incident which flattened a double-storey bungalow belonging to Affin Bank Bhd chairman Gen (Rtd) Tan Sri Ismail Omar, killing his wife, Puan Sri Azizah Abdul Aziz, son Hijaz, two in-laws, two grandchildren and two Indonesian maids, after tonnes of earth rolled down a slope.

The former soldier’s bungalow was located about 300m from the Highland Towers.

Ibrahim said since the Highland Towers tragedy, many studies were conducted by various groups, and the finding had been submitted to the relevant agencies and parties.

“My students and I have conducted studies on the slope failure which had caused the death of Gen (Rtd) Tan Sri Ismail’s family members. I did a thorough mapping on soil condition.” — Bernama
